Background checks are handy for various reasons, and divorce record searches are often used to conduct background checks. Since divorce records fall under the jurisdiction of the state government, the information from these records are usually accurate and up-to-date. There are various online divorce record search providers which can be useful in obtaining the information from divorce records and other public records such as marriage, birth and death records.

Public records are a rich and accurate source of information. A standard divorce record can contain the names, addresses, date and place of divorce, reason for divorce, children, custody, alimony, among many other details.

By entering the name of the individual you wish to search for, you can view all these records in order to get an overall view on someone's background and past. This allows for background checks to be conducted quickly and efficiently, with guaranteed privacy and confidentiality.

The question of what is a repetitive strain injury (RSI) is one that many people may not even know to ask. An RSI is not something that happens instantly like a cut or broken bone. RSI's happen over time, and you may not even realize you are being injured until it's too late.

Repetitive Strain Injuries is the blanket term given to any injury that is caused by a repetitive motion that is performed over a period of time. These injuries usually occur in or around the joints of a person's body. The pain from the injury will usually begin to show itself as inflammation of the joint that is performing the motion.

The medical definition of Repetitive Strain Injury is an injury of the musculoskeletal and nervous systems that may be caused by repetitive tasks, forceful exertions, vibrations, mechanical compression (pressing against hard surfaces), or sustained or awkward positions.

Pain medications can be used to eliminate the pain. The problem with this approach, however, is that the pain will hide the RSI symptoms leading the patient to return too early to activities that caused the injury.

Other treatments are actually preventative measures that should have been taken before the injury occurred, but will also help treating the injury once the person returns to the activity that was the initial cause. These include ergonomic considerations and exercise.

Sometimes learning to deal with the pain is the best treatment. If the injury causes such a disruption in a person's life that it's worse that the injury itself then learning to cope with the pain might be the best answer. This way the patient can resume their day-to-day activities providing they understand how to avoid making the injury worse.

Downside of Collaborative Divorce

The best way to avoid requiring a change of venue in a divorce is to be the first to file. The first party that files the divorce papers and serve the other with the papers, provided that the papers were filed in a proper venue, will decide which courts hear the case. If your spouse takes the children to another county and you do not try to stop the move, once the papers are filed it may be much harder to get the venue changed to a more desirable location.

After a certain period of time, and especially if the children are enrolled in school in the new county and are involved in the local community, it may be even more difficult to move the venue. For an individual to file a dissolution within a county in California, they must have resided in that county for three of the previous six months. For a legal separation and for cases involving domestic violence, the three months are not even required.

The court may consider the hardship or possible expenses that the party wishing to change the venue may incur if the case is tried in the county in which the papers were filed. However, if the filing party has been in the county for a long period of time, it may become harder to get the change of venue. If children are involved and it is determined that the children have not been tied to their new community, the court may determine that it is best to hear a case in the county in which they spent most of their lives.

A Collaborative divorce avoids the costs and conflict of divorce litigation by creating a conflict resolution process that removes the couple from the Courtroom and allows them to resolve their issues peacefully, while incorporating the advice and counsel of collaboratively trained professionals.

When a couple chooses to pursue collaborative divorce by means of the Collaborative Law Process, they must agree to forgo adversarial divorce proceedings. Typically, each will first hire an attorney trained in the Collaborative Law Process. The collaborative attorneys and the couple will agree, in writing, to keep the dispute out of Court. After choosing their collaborative law attorneys, the parties may choose to work with other collaboratively trained professionals, commonly referred to as team members. These team members can include a financial neutral, a child specialist, and a divorce coach. Collaboratively trained professionals can be hired by either party or shared, depending on the needs and circumstances of each family. After the parties reach a final agreement in their collaborative divorce, their agreement is incorporated into a Judgment for Dissolution of Marriage. The divorce is final when the Judge enters a Judgment for Dissolution of Marriage as an order of the Court.

Collaborative law is based on the concept that the parties share the common goal of completing the divorce process efficiently and amicably. The Collaborative Law Process can also save you and your spouse money if each of you fully commits to the process. This typically means sharing all relevant financial data and being willing to compromise on important issues like maintenance, child support, custody, and property division.

A collaborative divorce is only as good as the attorneys who assist with the case. Be sure to research your collaborative lawyer's training. Each state will have an organization that provides training and resources to collaboratively trained professionals. Membership in these organizations is a sign that your attorney has undergone the necessary training to learn and understand the process and that he or she continues to study and remain current in the Collaborative Law Process.

In order for your divorce to proceed smoothly, your collaboratively trained attorney should have experience in the Collaborative Law Process. If your attorney has only handled a few collaborative divorce cases, he or she may not be as knowledgeable or resourceful as a more seasoned collaborative divorce attorney. You should feel comfortable asking about your attorney's experience in collaborative law. An experienced collaboratively trained attorney will have a depth of knowledge to guide you in making decisions about your family and will also have access to a vast array of financial advisors, divorce coaches, and child specialists to assist with your divorce. Experience with the Collaborative Law Process will guide your attorney in determining which professionals are the best choice for your family.

Medical malpractice is an act by a health care provider that deviates from acceptable standards of practice in the medical community. Basically, medical malpractice is professional negligence which causes an injury to the patient.

The United States has developed a specific medical law covering medical malpractice. A doctor will be liable of medical malpractice unless he/she is shown to have acted in accordance with a reasonable body of medical opinion.

One type of medical malpractice is birth injury. Occasionally during birth, a child may suffer physical injury as a result of doctor mistakes, hospital mistakes or by the mistakes of other professionals during the delivery process. Common birth injuries include skin irritations, fractured collar bones, brain damage, Cerebral Palsy, Erb's Palsy and temporary paralysis. Brain damage is obviously the most serious form of birth injury as it can result in seizures, strokes and mental retardation later in life.

If you or a loved one has been a victim of medical malpractice it is very important that you seek help immediately. You may be entitled to financial compensation for your injuries. The general rule in medical malpractice death cases is that one is entitled to recover both economic and non-economic damages suffered as a result of the loss of a loved one. Please contact our experienced medical malpractice lawyers immediately.

Key Litigation Issues in Motorcycle Accidents

Truck drivers frequently are the victim of a bad reputation. They are commonly seen as being reckless individuals who gun down smaller cars with their vehicular behemoths. Their 80,000 pound vehicles cover millions of miles a year. They move large quantities of goods every day and are an integral part of commerce in the United States but are still seen as being dangerous. This is most likely due to the unsafe drivers of the past. Trucking companies, in recent years, have improved the safety of 18-wheelers in recent years but there are still an alarming number of accidents. In addition, the Federal Motor Carrier Safety Administration estimates that 1 out of every 20 truck drivers, or 5%, will be involved in accident.

A claim supplement is a claim for additional repair or replacement costs. Supplements are commonplace in the claims process. However, if you are a policyholder unaware of your policy rights, you could be walking away from hundreds or thousands of dollars that you are entitled to collect.

Claim supplements usually occur after a policyholder submits a claim, gets paid and gets the repairs or replacements completed. Then, additional damage is discovered some time later.

Many people erroneously think that, once the claim is closed, it cannot be re-opened. And, insurance companies and their adjusters usually don't rush to tell you how to submit a claim supplement. So, what to do? Let's look at car insurance claims and property insurance claims.

For any kind of supplemental claim, you must contact your insurance company and give them your original claim number. The best way to notify the company is in writing, sent Certified Mail. That way, you'll know who signed for the letter. The insurer will have to re-open the claim. You might get the same adjuster as before, but maybe not.

Be sure that you are collecting all the money you are entitled to collect. Use supplemental claims whenever your claim requires it.

If you have experienced a property loss, whether fire, wind, flood or other, you need to know winning insurance claim strategies. The insurance company will not tell you the claims process, but I will. I will show you how to take control of your insurance claim, and add hundreds or even thousands more dollars to your claim settlement. For more information, go to the website listed below.

Coal Workers Pneumoconioses (CWP) - Anthracosis, Silicosis and Byssinosis

A will can be used, when executed, directs the disposition of your estate at death. The term "Intestacy" deals with state statutes that govern distribution of the property of a person who dies without a valid will or whose will does not completely dispose of his estate. In most states, the rules are the same for real and personal property. Heirs and next of kin are synonymous and describe persons who take either real or personal property by intestacy. Generally, the state where a person lives when death occurs determines the disposition of personal property. The disposition of real property is determined by the law of the state where the real property is located.

Intestacy statutes (or wills) apply only to a decedent's probate estate. This consists of assets that pass by will or inheritance and are subject to administration by the decedent's personal representative, (cash, real estate, and personal items). Non-probate assets pass under contract, (life insurance proceeds, trust assets, etc.). If a will is valid than it rules, but if there was no will or the will was not valid or does not make a complete disposition of the decedent's property, than the intestacy succession statute applies. Again for personal property, remember the law of the decedent's state where they lived governs. For real property, the law of the state where the property is located governs.

The most asked question is, "How should the property be distributed?"

Some general rules are as follows:
1.Spouse usually takes half or a third if there are decedents, if not, all distribution of assets goes to the spouse
2.Children take all if there is no surviving spouse or a smaller amount if there is a surviving spouse.

These rules apply to "separate property". Different rules apply to community property. Keep in mind if your state is a community property state, the spouse already owns on half of all community property. Some states that have community property are:

Revoking a Will:
1. By law- Changes in a will may revoke all or part depending on state law
2. By executing another will, revoking the previous one
3. Physical destruction: tearing up, burning or writing "Cancel across the face of the will.

In most cases a complete, formally executed will do not need other documents or act to administer the to the decedents estate. There are grounds for contesting or challenging a will and usually involve the following:
1. Was the will properly executed?
2. Was it revoked?
3. Did the maker lack the capacity?
4. Was there lack of intent?
5. Was there undue influence, fraud or duress?

A person may contest or challenge a will only if they are interested parties, (direst interest in the estate). There can be a no-contest clause in a will, called an "Interrorem". This provides that any person who contests the will shall forfeit all interest in the estate.

Steps in Administration of the Estate:
1. Opening estate proceedings
2. All proceedings subject to court supervision and control
3. Jurisdiction-State of decedent's death

There are fourteen (14) states that have adopted the Uniform Probate Act: Alaska, Arizona, Colorado, Idaho, Maine, Michigan, Minnesota, Montana, Nebraska, New Jersey, New Mexico, North Dakota, Pennsylvania, and Utah.

The importance of estate planning is essential to protect yourself and your family. Make sure you consult with the proper person to provide you with all your financial needs in planning your future.

I Need A Personal Injury Lawyer

Personal Injury Attorney - Why Do You Need One?

White collar federal defendants and their families have questions about prison. Who can provide the answers they need? Their lawyer never spent time in prison. Who do you call?

White collar defendants are usually faced with the prospect of having to go to prison for the first time. They are afraid of what they will face. They want to know how to prepare themselves and their families for their ordeal.

Where will I go? What will I do when I get there? Will there be violence? How am I going to manage? Who is going to care?

Prison consultants provide the answers to these questions and so much more. A good prison consultant can prepare you and your family to navigate this process so you and your family can manage to survive the experience of federal prison. You need to come out with the fewest scars possible.

The money invested in a prison consultant is nominal when compared to the benefits. Consider the benefit of knowing that your family has someone to call who can provide answers to their questions when you are gone. Add to that the comfort of knowing what to expect when you arrive at the gate. Combine that with being prepared to avoid mistakes and knowing how to minimize your time in prison and you have a sense of the value of your investment in a federal prison consultant.

You only have one chance to prepare for this experience. This is not the time to cut corners. Too much is at stake.

Divorce Mediation - The New Alternative

In order to fully understand the relationship between asbestosis and mesothelioma, and clearly distinguish between these diseases, we must first learn about the cause, then set about defining each condition in a clear, yet non-technical manner.

What is Asbestos?
The name Asbestos was first given to this toxic mineral by the Ancient Greeks, and the word "Asbestos" literally means inextinguishable. Throughout much of the twentieth century asbestos was widely used in industry because of it's resistance to heat and flame, resistance to electricity and excellent insulation and sound proofing qualities. It is estimated that there are approximately 3,000 different commercial products which include the use of asbestos in the manufacture process.

Asbestos is made up of tiny microscopic fibers which are invisible to the naked eye, and these fibres will often become airborne when the material is damaged or disturbed. Once carried by air, the fibres may be inhaled into the lungs or even swallowed into he digestive system where they will almost certainly cause long term, significant health problems. Inhaled asbestos fibers will remain in the body and never be expelled, and because of this, the fibers penetrate body tissues and will often deposit themselves in airways and lung tissue.

There are six minerals which are defined as "asbestos" types. These are chrysotile, crocidolite, amosite, actinolite, tremolite and anthophyllite. The three most commonly used asbestos types are classed as white, brown, and blue, and it is the brown and blue asbestos types which are most often associated with being the cause of mesothelioma. Millions of people all over the world have been affected by the inhalation of asbestos fibers, putting them at risk of contracting asbestosis, mesothelioma, lung cancer, or other deadly diseases directly caused by these toxic levels of asbestos.

There are also major differences in the treatments of asbestosis and mesothelioma. Whilst treatment for asbestosis centers around preventing the condition from deteriorating and easing the symptoms, treatment for mesothelioma will depend on how far the cancer has developed. If diagnosed early enough, there is a good possibility that the cancerous tumors can be removed or abnormal cells killed using radiation or chemotherapy. Later stages of mesothelioma cancer can be treated, but treatment becomes more difficult if the cancer has spread to other parts of the body. Regardless of the type of treatment, both asbestosis and mesothelioma have a very poor prognosis.

Usually, will disputes happen when one of the beneficiaries has a conflict about how the property is going to be distributed. Normally, one of the beneficiaries brings up the dispute. However, a third party may also file the dispute and their name may not be mentioned in the will. If you want to know more about this subject, you may want to read through this article. This article gives some examples of will disputes and the best ways to handle them.

Most of such disputes are filed after the death of the person. The reason is that most people have no idea about the contents of the will, and they come to know about it after the death of the property owner. Therefore, most of will disputes involve the estate administrator.

Examples of Will Disputes

Common solutions for the disputes involve monetary awards as compensation to the relevant parties. As an alternative, the judge may choose to order a new way of distributing the property.

Do You Need a Will Dispute Lawyer?

To cut a long story short, wills are complicated documents. Generally, most people don't understand the legal matters involving wills. Therefore, if you are in trouble, you may want to hire the services of a will dispute lawyer. The lawyer will help you in drafting, editing or reviewing the will document. Aside from this, they will also help you with the will dispute. They can also help you in filing a case. So, hiring a lawyer will be a good idea.

With record breaking unemployment across the country, there should be no surprise that there is also a record number of unemployment fraud cases. After handling many unemployment fraud cases over the past two years, I have seen some common patterns. Thus, I hope this article helps people accused of or charged with unemployment fraud just as I have helped many of my own clients.

The actual crime of unemployment fraud is rather simple. It usually involves a person claiming unemployment benefits when they are actually employed. In some cases, the person claims they are not working at all to obtain maximum benefits. In other cases, the person claims that they are working less hours than they actually are, again, to obtain more benefits than they otherwise would be able to.

The large spike in unemployment fraud cases is directly related to the cause of unemployment fraud. While there are plenty of people that are looking to get money that they shouldn't get, there are also many people that are confused by the entire unemployment process. Thus, some real unemployment fraud cases are related to the economy and the need for money. People that would never steal from someone or sell drugs find it easy to tell a small lie to get the to government to give you more money to help make ends meet. However, other people don't understand how the process works and accidentally make false claims when reporting into unemployment.

As there are many defenses to unemployment fraud, the best thing you can do to defend yourself will be to speak to a defense lawyer before you do or say anything. Don't worry about what message it may send to unemployment. Don't think that you can explain your way out of the situation by yourself. Many people are prosecuted for unemployment fraud and many of them confess. Without a confession, the State may have a tough time meeting their burden of proof no matter how good the evidence is. With a confession however, the State usually has a slam dunk conviction. Only an attorney in your state can properly advise you as to what to do or say if you are contacted by unemployment for a fraud investigation.

Going through a divorce is an emotionally and financially taxing time. To make matters worse, the complexities of the unknown process and the adversarial conflict that often accompanies divorces increase the stresses tenfold. One has to ask, "can you have a civilized divorce and minimize the financial and emotional conflict?" Attorney - Mediator Katherine E. Stoner answers this question with an unflinching, "Yes!" Her book, "Divorce Without Court: A Guide to Mediation & Collaborative Divorce, 2nd Edition" provides a guide to the steps necessary to negotiate a divorce settlement using divorce mediation or the new innovative approach called collaborative divorce. Even if you chose to go through a divorce the traditional way with both parties "lawyering up," I believe the advice in this book could prove useful in finding resolution, especially if your state requires mediation during the process.

I do think this book will be extremely valuable as an addition to the nuts and bolts type book for anyone who wants to avoid a messy litigated divorce and attempt a mediation or collaborative approach. As an attorney-mediator myself, I believe in mediation 100%. It can be so much more effective than litigating. I don't have the experience with collaborative divorce, but have learned more about the collaborative areas of law during continuing legal education conferences and believe it to be a process that can greatly assist people in certain areas. If you are facing divorce, regardless if you have an attorney or will do it yourself, Stoner's "Divorce Without Court: A Guide to Mediation & Collaborative Divorce" can save you time, money, and reduce the stress associated with an already extremely difficult situation.

Legal Separation - How It Differs From Divorce

Congratulations on beginning the process of learning how to get your will and testament completed.

Firstly, a last will and testament is a legal declaration by which a person can sort out what happens to their money, property and possessions after their death.

Below are some of the ways to do it:

• A wills attorney - This is legal specialist in the writing of a will. A wills and trusts attorney can sort everything out for you so that you won't need to know anything about the subject. They can create a will for you that will satisfy all the legal requirements and can tailor your will and testament to suit your needs and circumstances.

• Wills online - These are websites that have online will writing software programs that typically involve inputting answers to a series of questions and then compiling your answers in to will and testament ready for you to print off at the end of the process. Some sites will also have a legal professional who specialize in wills and probate laws to check it over for you before the print off stage.

You get varying levels of help and assistance with the different options mentioned above. Generally speaking, like most things in life, the greater the amount of help you want then generally the higher the costs get.

The cost of making a will ranges from zero cost for a total do it yourself will template; from about five to a hundred for the products and services in between; all the way up to a few hundred for some in depth help from a wills attorney. Remember the wills attorney costs are typically based on a time basis, so the better prepared you are before you meet them the less time they will need to spend with you. For this reason some will and trust lawyers may offer fixed prices for wills that follow a standard format.

The Anatomy of the Repetitive Strain Injuries (RSI) Epidemic

Motorists and passengers now face fines of £60 as a deterrent for minor safety offences. In the latest safety initiative by the UK government, the penalty fines for not wearing a seatbelt will rise from £30 to £60 from today. The penalty for motorists who have deliberately disguised or altered their number plates has also doubled to £60, as a reaction to concerns from the police that their warnings are going unnoticed.

When awarding compensation to the victims of non-fault road traffic accidents (RTA), the courts will take into account whether or not the victim was wearing a seat belt. Any compensation awarded to an accident victim who was not wearing a seat belt will typically be reduced by around 30% if the injuries could have been completely prevented or significantly reduced or by 15% if the injuries could have been slightly reduced.

Legal Separation - How It Differs From Divorce

There are many attempts these days to avoid litigation. Despite its warts, the American legal system (including the court system) is the best in the world. For not much money in terms of filing fees, one can be heard by an elected judge (in most cases) who is absolutely impartial. If you don't like the result, you can usually appeal. If the decision was wrong, it will usually be reversed. The primary expense of litigation is attorney fees.

Collaborative divorce carries the cost of attorney's fees and not the protection of a court. It urges people to use "joint" accountants and appraisers and be bound by their opinions, even if there are valid grounds for contesting those opinions. The attorneys sign an agreement with their own client and with the other side, (as I understand) promising not to represent the client if negotiations break down and litigation becomes necessary. The usual loyalty an attorney feels for the client is compromised, because even if the client wants that attorney by his/her side, the deal has been struck. In that event, all the time and money spent with the first attorney is lost, and the client is expected to find another attorney, forge a new attorney/client relationship, and basically start all over again.

If you are considering a collaborative divorce, it would serve you well to consult with another attorney and consider the advantages and disadvantages of both approaches in your particular case. Further, don't expect that a collaborative divorce will necessarily be cheaper. Because you will forfeit your attorney if you leave the process, you may become hostage to the process and spend longer there chasing a result you want then you would in proceeding to trial.

The Importance of Public Liability Insurance

In New Jersey, we do not have legal separation as some other states do. In New Jersey, if you are living apart from your spouse, the courts consider you separated. There is no legal separation before divorce in New Jersey, if you are living apart, you are separated in the court's eyes. This means you do not have to file a complaint in New Jersey to be separated where as in some other states you have this other hurdle to jump through.

If you and your spouse choose to create a formal agreement in regards to responsibilities that each of you chooses to take on while you, decide whether or not you will choose to file for divorce, a good divorce attorney can help draft this document. There are many reasons that you may choose to create such agreements, such as; child support, visitation, the distribution of responsibilities in regards to the raising of children, how assets and liabilities will be handled in the short term as well as joint assets and liabilities. These agreements can help set the tone for divorce settlement, once a complaint of divorce is filed.

The next thing you must realise is, that, if your spouse fails to keep to their end of the agreement, is that, you should confront your spouse, and find the reason why he or she has not kept up their end of the agreement. It may not have been intentional. However in most cases it is. After speaking with your spouse, you can then, make an educated decision as to whether or not to continue moving forward on the agreement, or, hire a divorce attorney, and file a complaint of divorce. The one thing I would say in regards to this, is to not wait too long to speak to a divorce attorney, if your spouse does not get back in touch with you.

In this article we're going to discuss some of the most famous patents in history. These are inventions that greatly changed the world we live in.

To go over all the patents that have changed the world would take a month of Sundays and then some. What follows is just a brief look at some of the greatest patents in our history.

What is considered the most valuable patent is the one issued to Alexander Graham Bell for his invention of the telephone. The patent was number 174,465 issued in 1876. Ironically, early attempts to make the telephone popular were unsuccessful. People looked at the idea as nothing more than a novelty and didn't take its communication possibilities seriously. Try telling that to all the people walking around with cell phones today.

Probably the most famous patent was the one issued to Frederic Auguste Bartholdi for his design of the Statue Of Liberty. The Statue Of Liberty came to New York on June 19, 1885. It was a gift of friendship given to the United States from the people of France. It was intended to celebrate their 100 years of independence 10 years earlier.

The statue is constructed of copper sheets which are assembled on a framework of steel supports. In order to be transported to America the statue was disassembled into 350 pieces and was packed in 214 crates. It was then reassembled when it arrived. Nothing like this was ever done before and most likely will never be done again.
